1. Scope of Work KM Electric will perform only the work explicitly described in the approved estimate or proposal. Any items, tasks, or materials not specifically listed are not included and will require a separate estimate and written approval. Verbal agreements or assumptions are not binding unless documented in writing.
2. Estimates and Pricing All pricing is based on current material and labor rates and is valid for 30 days from the date of the estimate. Any changes to the scope of work may result in additional charges, which must be approved by the customer before proceeding.
3. Exclusions Unless specifically noted in the estimate, KM Electric's pricing does not include any patching, repair, or cosmetic restoration work. This includes but is not limited to: Drywall repair or texturing Painting or touch-up paint Siding removal or replacement Roofing or roofing penetrations Stucco, plaster, trim, or finish work It is the customer's responsibility to coordinate and pay for any repair or cosmetic work required after electrical installations or modifications unless specifically stated in the estimate.
4. Change Orders Any additional work requested by the customer, or required due to unforeseen site conditions, code compliance updates, or utility requirements, will be considered a change order and may affect pricing and scheduling. All change orders must be approved in writing.
5. Payment Terms The customer agrees to pay the full invoice amount on the same day the job is completed unless otherwise agreed upon in writing. If payment is not received by the end of the job day, a late fee of $25 per calendar day will be added to the outstanding balance.
6. Lien Notice In the event KM Electric must file a lien to collect unpaid balances, the customer agrees to pay an additional $2,500 administrative and legal fee to cover time, court costs, and paperwork.
7. Scheduling and Access The customer must ensure KM Electric has clear access to the work area on the scheduled service date. Delays caused by lack of access may result in rescheduling and additional charges.
8. Permits and Code Compliance KM Electric will comply with applicable local, state, and national electrical codes. If required, KM Electric will secure permits, and the customer will be responsible for permit fees unless otherwise specified.
9. Customer Responsibilities The customer is responsible for securing any necessary property access, clearing work areas of personal belongings, and providing accurate information about existing electrical systems. KM Electric is not responsible for delays or damage caused by hidden or undisclosed site conditions.
10. Warranties KM Electric offers a 20 year workmanship warranty on all new installations. This warranty does not cover: Customer-supplied materials Pre-existing electrical issues Damage caused by misuse, natural disasters, pests, water intrusion, or work by other contractors
11. Limitations of Liability KM Electric is not liable for indirect or consequential damages, including but not limited to lost profits, delays caused by third parties, or damage to existing property unless due to proven negligence.
12. Cancellations Cancellations made within 24 hours of a scheduled job may be subject to a cancellation fee of up to $150 to cover lost labor time and scheduling disruptions.
13. Governing Law These terms and conditions are governed by the laws of the State of California. Any disputes shall be resolved through binding arbitration or small claims court within Santa Cruz County.
